2. Scope of sale
BabySTA products are currently offered for sale to customers within South Africa only. We do not currently offer international shipping.
The merchant outlet country at the time of presenting payment options is South Africa, and all transactions on this website are processed in South African Rand (ZAR).
3. Product information
BabySTA is a baby feeding support product intended for use from 0 to 6 months of age.
BabySTA must:
• be used under adult supervision at all times;
• be inspected before each use; and
• be discontinued immediately if any wear, damage, cracking, tearing, distortion, or other defect is noticed.
We take reasonable care to ensure that product descriptions, images, usage guidance, and pricing are accurate. However:
• product images are illustrative and may vary slightly from the actual product;
• colours and appearance may differ depending on your screen or device; and
• product descriptions and pricing may be updated from time to time without notice.
We reserve the right to limit quantities and to discontinue products at any time.
4. Orders
When you place an order, you are making an offer to purchase a product from us.
All orders are subject to:
• availability of stock;
• accuracy of pricing and product information;
• verification of your order details; and
• receipt of payment.
An order will only be regarded as accepted once payment has been received and we begin processing the order. We reserve the right to refuse, limit, or cancel any order where there is a pricing error, stock shortage, suspected fraud, misuse of the website, or any other lawful reason.
If we cannot fulfil your order after payment has been received, we will notify you and refund the amount paid where appropriate.
5. Pricing and payment
All prices are displayed in South African Rand (ZAR).
Payment may be made using the payment methods made available at checkout through Payfast by Network.
Card transactions will be acquired for Happy Mom Happy Baby via Payfast by Network, the approved payment gateway for South African acquiring banks. Payfast uses secure encryption and card details are not stored on the BabySTA website. Customer details are stored separately from card details, which are entered by the customer on Payfast’s secure payment page.
6. Shipping and delivery
We currently deliver within South Africa only.
Estimated delivery times are as follows:
• Local shipping: Cape Town, surrounds, and selected parts of the Western Cape – 2 to 3 business days
• Standard shipping: all other regions within South Africa – 3 to 5 business days
Delivery times are estimates only and are not guaranteed. Delays may occur due to courier operations, public holidays, weather, high order volumes, remote delivery routes, or events beyond our reasonable control.
We use third-party courier providers, including The Courier Guy, to deliver orders. Delivery will be confirmed by courier tracking and/or delivery confirmation where available.
Risk in the goods passes to you on delivery.
7. Inspecting your order
You must inspect your order as soon as reasonably possible after delivery.
If the product arrives damaged in transit, is the wrong item, or appears defective on delivery, you must notify us within 48 hours of delivery by emailing info@babysta.co.za.
Your email should include your order number, a brief description of the issue, and clear photographs of the product, packaging, and any visible damage or defect.
This reporting requirement helps us investigate promptly with the courier or supplier where necessary, but nothing in these Terms limits any statutory rights you may have under applicable law.
8. Returns, replacements and refunds
Because BabySTA is a baby oral-use product, strict hygiene and safety standards apply.
Unless otherwise required by law:
• we do not accept returns for change of mind;
• we do not accept returns of opened, used, or hygiene-compromised products; and
• we provide replacements only, not general exchanges, for qualifying claims involving damage, defect, or supply of the wrong item.
We may require photographic proof and, where reasonably necessary, return of the product for inspection before approving a replacement.
Where a valid claim is established, our standard remedy is replacement of the product. If replacement is not reasonably possible, we will consider another appropriate remedy in accordance with applicable law.
Nothing in these Terms excludes or limits any rights you may have under the Consumer Protection Act, 2008, including the statutory protections relating to defective or unsafe goods.
9. Product safety and use
BabySTA must only be used under adult supervision, within the recommended age range of 0 to 6 months, and in accordance with the instructions provided with the product or on this website.
You must discontinue use immediately if any damage or deterioration is noticed.
We will not be liable for damage, loss, or injury arising from misuse, use outside the recommended age range, use without adult supervision, or continued use of a product after damage becomes apparent, except to the extent that liability cannot lawfully be excluded.
10. Privacy
We take reasonable steps to protect your personal information and to process it in accordance with applicable South African law, including the Protection of Personal Information Act, 2013 (POPIA).

11. Intellectual property
All content on this website, including text, graphics, logos, photographs, product descriptions, branding, layout, and design, is owned by or licensed to Happy Mom Happy Baby unless otherwise stated.
